Partner Visa Subclass 309 & 100

The Partner (Provisional and Migrant) Visa – Subclass 309 & 100 allows the partner or spouse of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia.

It is a two-stage visa:

  • Subclass 309 is the temporary visa, granted first.
  • Subclass 100 is the permanent visa, granted later once eligibility is met.

Requirements for Partner Visa 309 and 100

To apply for the Partner Visa (Subclass 309 & 100), applicants must meet the following requirements:

  • You must be outside Australia when applying.
  • You must be married to or in a de facto relationship with an eligible Australian citizen, permanent resident, or New Zealand citizen.
  • The relationship must be genuine and continuing.
  • You must meet health and character requirements.
  • You and your partner must provide proof of relationship, such as joint financial records, shared household evidence, and social recognition.
  • You must have no outstanding debts to the Australian Government.

Eligibility Criteria for a Partner Visa 309 & 100

You may be eligible for this visa if you:

  • Are sponsored by your partner (an Australian citizen, permanent resident, or eligible NZ citizen).
  • Are outside Australia at the time of application and when the visa is granted.
  • Are in a genuine and continuing relationship with your partner.
  • Meet the health and character requirements.
  • Have no visa cancellations or refusals that would prevent you from applying.
